USAttorneys Can Help Aid You in the Process
Do you have an elderly loved one in a nursing home and believe they are the victim of abuse, neglect, or mistreatment? While you may think it is uncommon for a nurse or other health care worker to display abusive behaviors, many fail to provide their patients with the standard level of care that a patient is required to be given. Trouble is, many of these unfortunate victim’s experience conditions such as Alzheimer’s and dementia that restrict them from remembering or being able to recite what it is they have been subjected to.
Nursing Home Facility Requirements
Every assisted living facility has certain requirements they must fulfill and an environment they must sustain. According to the North Dakota Licensing Rules for Nursing Facilities, per section 33-07-03.2-08,
- The facility must provide an environment that is maintained, clean, comfortable, and appropriately responds to the physical, functional, and psychosocial needs of the residents. The facility must provide adequate space, lighting levels, ventilation, and safety measures consistent with the services being offered and the needs of the residents being served.
Although there are several nursing home facilities located in the state of ND, not all of them are up to par with state requirements. Some are recognized for their lack of cleanliness which can affect the health and wellbeing of your loved one, while others are overly crowded and the staff are unable to tend to their patients as frequently as they should which puts them in a violation of the state laws.

North Dakota Resources
The North Dakota Department of Health strives to keep residents informed of what actions they can take in the event a family member or someone they know isn’t being properly cared for in an adult assisted living facility. Cases of malnutrition, physical and verbal abuse, neglect, etc. all need to be reported immediately to the North Dakota Department of Health. You can contact them by one of two ways:
- Calling them at 701-328-2352
- Visiting their website at http://www.nd.health.gov.
When you elect to place your family member in one of these facilities, they are obligated to abide by state regulations along with those of their individual facility. When they fail to do so, which many do, you need to be proactive and make every attempt to get this person and/or facility recognized for their wrongdoing.
The North Dakota Department of Health also allows you to view their current list of certified nurse aides who have been placed on a validated abuse list. You can view that list right here.
